Consumer wins case against Maruti Suzuki dealer over discount fraud

Having purchased a Maruti Suzuki Alto K10 car on March 16, 2015 for INR 3.55 lakhs, the dealership promised Mr Vijay Kumar a discount of INR 27,100 and a gold coin weighing 2 grams. Kumar, 28, a resident of Sector 28 failed to receive either the discount or the gold coin even as the same were promised within three days of completion of formalities with regard to purchase of the vehicle.

The complainant also stated to the Panchkula district consumer forum that Modern Automobiles, the authorized Maruti Suzuki dealership located at Sector 8 had promised exchange benefits on old vehicles. As a result, he took his old car to the dealer for which the value was assessed at INR 55,000.

Kumar stated that he had come across certain advertisements promising discounts, gold coin and exchange benefits and had hence approached Modern Automobiles, Panchkula. Despite repeated visits to the shop he did not receive the benefits and was hence forced to file a complaint with the forum.

The dealer argued that Kumar did not fulfill certain requirements of the scheme and hence the same was not given to him, while the court ruled in Kumar’s favor. The court stated that advertisements were published for attracting the attention of customers and did not disclose all terms and conditions of the scheme.

The court hence directed the dealership and Maruti Suzuki to pay Kumar the full discount promised and the gold coin which will be given jointly by Maruti Suzuki and the dealer. INR 10,000 will also have to be paid as compensation for harassment and mental agony while INR 5,000 was as cost of litigation for failing to abide by the conditions of the advertisement.
