Haryana Transport Commissioner to refund passengers for allocating bus seat without push-back

It was on April 21, 2015 that Vibha Dhiman of Modern Housing Complex, Mani Majra travelled from Chandigarh to Delhi on Haryana State Transport Volvo bus No. HR 55 S 4602 with her uncle and aunt. Dhiman purchased tickets for INR 1,560 at INR 520 per ticket and boarded the bus at ISBT, Sector 17, Chandigarh at 9 am. Shortly after boarding, various difficulties arose which caused the travellers much inconvenience.

After crossing Ambala, the seat on which the aunt was sitting posed problems due to malfunctioning of push back seat button. After the bus crossed Zirakpur, while a film was screened on the TV set at the front of the bus, the TV set at the rear was blank due to which passengers at the rear could not view the film.

While these complaints angered travellers, what added further discomfort was harsh sunlight that streamed in through the window. The complainant’s uncle suffered from Macular hole in one of his eyes and was subjected to severe sunlight as the windows lacked sun shade/protector/curtain which is a prescribed standard by a Supreme Court order.

Dhiman filed a complaint with UT Consumer Disputes Redressal Forum which has further directed Haryana Transport Commissioner to pay compensation to three members of the family. Consumer forum, headed by President Rajan Dewan along with Jaswinder Singh Sidhu and Priti Malhotra have directed Haryana Roadways to cough up INR 2,000 as compensation and INR 5,500 towards litigation costs for both physical and mental torture caused.

Everyday, millions of travellers use state transport system in India. Though most buses are in good condition and are looked after, there are some buses which misses out on promised facilities. This could be in the form of AC blowers not working, water leaking, dirty seats, push back not working, and so on. This order brings to light that the customer has the option to take the matter further and claim for damages, if made to travel in a bus where promised facilities are not on offer.
