Renault Duster owner to get compensation of Rs 2 lakhs – Here’s why

A lawyer who moved Consumer Court in what was seen as a Fake Lucky Draw Offer from Renault India has been awarded compensation of Rs.2 lakhs.

Renault India dealership has been directed by the Consumer Disputes Redressal Forum of Kollam to pay out a compensation of Rs. 2 lakhs to the complainant. This is in view of a Lucky Draw offer issued by Renault India during the Onam festival season of 2014. The case was filed under Section 12 of the Consumer Protection Act.

According to the complainant, Renault India dealership put out a Lucky Draw Offer which entitled buyers to a lucky draw coupon on the booking of a Renault vehicle in August 2014. The winners were entitled to win 5 Duster SUVs as a part of this lucky draw scheme.

The complainant, a lawyer, booked his Renault Duster on 16th August 2014 and was issued a lucky draw coupon. The car was delivered to him but there was no update on the lucky draw. Follow ups with the manger of the said dealership went unanswered and though he was told that the results would be intimated by SMS, that too did not happen.

This lack of transparency pushed the lawyer to file a case with the Consumer Disputes Redressal Forum. He opined that he was cheated by the Renault Dealership and that the lucky draw was not conducted in a transparent manner.

There was no proof that the lucky draw was conducted, who the winners, if any, were and this resulted in unfair trade practice and deficiency in service and cheating of customers into believing that they could be one of the lucky winners.

The draw could have been issued just to attract buyers but the dealership had no intentions of going ahead with the declaration of winners or issuing 5 Renault Dusters apart from other assured gifts as prizes. The Forum, lead by President E.M.Muhammed Ibrahim and Member S.Sandhya Rani, stated that this Lucky Draw Scheme, which was issued in the new papers and on TV channels, was indeed faulty and put out solely to attract customers into booking a new Renault vehicle.

The said Renault India, Cochin dealership has been instructed to pay out compensation to the complainant to the tune of Rs.2 lakhs for mental agony caused along with Rs.10,000 to cover costs. You can read the full legal order here.
